TERMS AND CONDITIONS

General

This is a legally binding contract between the “Property Owner”, Michael Evans trading as Kent Border Cottages and the Holidaymaker. The term “Property Owner” in this contract will be a collective term referring to Michael Evans and or his designated staff or representative(s) also referred to as "we" and "us". This contract will be governed solely by UK Law.

The “Holidaymaker” is the person who signs the Booking Form or in the case of online booking the person who completes and submits a Booking Form from www.kentbordercottages.co.uk the Kent Border Cottages official website having read and accepted these Terms & Conditions.

The Holidaymaker signs or completes the Booking Form on behalf of all adult members of the party and is responsible for ensuring that they have read and accept the contract and these terms & conditions on a joint and several basis. The Holidaymaker and his or her party is hereinafter also referred to as "you".

The “Property” referred to is the holiday accommodation identified on the Booking Form. For the avoidance of doubt any holiday accommodation made available under this contract is designated solely as holiday accommodation. This means that it is rented out to the Holidaymaker for a term or terms limited to either weekly lets or short term breaks as agreed subject to the payment in full in advance of the price quoted on the Booking Form and these Terms & Conditions. Occupation of The Property even if it continues after the agreed period shall not be grounds for further occupation and no rights of tenure are offered, granted or conveyed by this agreement.

The Booking Form is any form requesting holiday accommodation duly completed to the satisfaction of Kent Border Cottages that requires acceptance of these Terms & Conditions.


Bookings

A booking deposit is payable within 5 (five) days of the Booking Form being submitted.  The booking is taken on a provisional basis until the deposit has been paid in full and funds cleared through the banking system (where appropriate). The booking then becomes confirmed. Until the booking is confirmed, it can be cancelled at any time without prior notice.

The balance of the rental charge, along with the breakage deposit, is payable not less than 12 (twelve) weeks prior to the start of the holiday. Failure to pay the deposit or balance in full by the due dates will constitute a cancellation of the holiday by the Holidaymaker. Please be sure to note the due dates of these payments as reminders are not routinely issued.

Bookings made less than 12 (twelve) weeks prior to the arrival date must be paid in full at the time of booking.

If, after we have confirmed your booking, you wish to then change the dates of your holiday, then you may do so only up to 90 days prior to the start of your holiday  and only subject to availability.

Payment methods: -

  • Sterling cheque, drawn on a bank with UK clearing, payable to Kent Border Cottages.
  • BACS payments to Barclays Bank sort code 20-49-76 account number 63210650 in the name of Michael Evans trading as Kent Border Cottages.
  • Most credit/charge cards - Visa, MasterCard etc. Subject to a 2% surcharge
  • Debit cards - Switch, Solo, Visa Delta, Visa Electron.


Cancellation by the Holidaymaker

We do not offer any holiday insurance as part of your booking so you should ensure you take out your own adequate insurance cover before making a booking and protect yourself against events beyond your control that may lead to you needing to cancel or curtail your holiday. You are personally liable for any cancellation charges and failure to receive compensation under any insurance you might have does not release you from this liability.

At the time of confirmation of your holiday you become liable for the charges as follows. If you cancel more than 60 days before the start date of your holiday you will receive a full refund of any money paid. Should you cancel more than 30 days before the start date of your holiday but less than 60 days you are liable for 50% of the total cost of your holiday rental. Should you cancel less than 30 days from the start date of your holiday you are liable for the full cost of your holiday rental and no refunds will be given.

Cancellation by the Property Owner

The Property Owner will endeavour to make sure the stated Property is available for the dates contracted. In the unlikely event that the Property becomes not available and we have to cancel the booking we will endeavour to find you suitable alternative accommodation. If suitable alternative accommodation cannot be found, you shall be entitled to a full refund. We will only be liable to return the monies received. No compensation or consequential losses shall be paid.


Miscellaneous

Whilst every care is taken to provide a true and accurate description of the Property, over time, alterations are made and some things do change. The Holidaymaker accepts that no refunds are available for such discrepancies.

The Property Owner reserves the absolute right to be given access to the property at any reasonable time during your holiday.
 
The Property Owner reserves the right to refuse entry to anyone, who in the Property Owner's opinion is not suitable to or capable of taking charge of the property.

The Property Owner reserves the right to terminate immediately any occupation of the Property if in our sole opinion there is damage to the property, unreasonable behaviour or disregard for local or national laws or bi-laws. No refund will be given if there is a termination of the holiday under this condition.


Number of Guests

Only those people named on the booking form are entitled to stay. If it is found that more people than agreed are using the property, this will be considered a breach of contract and the Holidaymaker and his/her party will be asked to leave immediately without any refund. Sub letting or assignation of the let is prohibited.


Pets

Pets are allowed in the property subject to the property owner's agreement. All pets must be house trained and the number and type of pet must not exceed what was agreed at the time of booking, otherwise a breach of contract will be deemed to have taken place.

Pets must not be left unaccompanied in the property at any time and must not be allowed on the beds or furniture. The holidaymaker shall be liable for all damage caused by his/her pet or any pet belonging to the holidaymaker's party. A charge will be made for any additional cleaning required. The property owner cannot be held responsible for any accident or injury to a pet during their stay.


Arrival and Departure Time

Every effort will be made to have the Property available from 16:00hrs on the day of arrival. The property must be vacated by 10:00hrs on the day of departure. Late departure will result in an additional charge being made. Information about keys and how to collect them will be provided once full payment has been received.


Liability

The Property Owner takes no responsibility for the personal possessions of the Holidaymaker or the holidaymaker's party. Vehicles and possessions are left entirely at the risk of the Holidaymaker.

Children must be supervised at all times.


Cleaning

We would like to think the Holidaymaker and party would treat the property as they would their own home and at the end of the holiday the Property is left in a clean and tidy condition. The Property Owner retains the right to make an additional charge for cleaning should the Property not be left in a similar condition to the way it was found at the start of the holiday.


Breakages

The Holidaymaker should make every effort to keep the Property, fixtures and fittings and all contents in the same state of repair and condition as at the start of the holiday. Any accidental damage or breakages should be reported to the Property Owner prior to departure. We retain the right to make an additional charge for damage and breakages although it should be noted that minor breakages and reasonable wear and tear (in the opinion of the Property Owner) will not be charged for.


Complaints

We try to do everything possible to give you a successful and enjoyable holiday but sometimes things do go wrong. If you have issues please let us know as soon as possible so that we have the opportunity to put things right. If, after this, you feel that the problem was not resolved to your satisfaction then you must put your complaint in writing to us within 14 (fourteen) days of your departure. We regret that we cannot enter into correspondence in the case of complaints made after departure when we, or our staff, were not given any reasonable chance to investigate or correct the problem.


Return of Breakage Deposit

Your breakage deposit, minus any deductions, will be returned to you within 14 (fourteen) days of the departure.
